1 Acceptance of Terms

These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you," or "your") and VROOOMS("Company," "we," "us," or "our"), governing access to our internet speed testing service, website, and related tools (collectively, the "Service").

By visiting, accessing, or using any part of the Service, you affirm that you meet the minimum age requirement in your jurisdiction for entering into contracts, have read and understood these Terms, and agree to be bound by them together with our Privacy Policy and Cookie Policy.

2 Description of Service

VROOOMS provides a browser-based connectivity experience centered on measuring qualities of your internet path, including, where supported:

• Download speed (Mbps/Gbps)
• Upload speed (Mbps/Gbps)
• Latency / ping (milliseconds)
• Packet loss percentage
• Jitter (network stability)

The Service is for informational purposes. Results are estimates and may vary due to routing, congestion, device capability, VPNs, browsers, concurrent traffic, measurement endpoints, Wi-Fi interference, and other factors.

3 Accuracy of Results

Results may be affected by many factors, including:

• Distance and path quality to measurement servers
• Network congestion at the time of test
• Hardware limitations of your device or router
• Browser performance and background processes
• Wi-Fi interference or signal quality
• VPN or proxy usage

We do not warrant that results reflect your maximum possible speed, contracted speeds, or performance of any specific application.

4 Permitted use

You may use the Service for lawful personal or internal business purposes in line with these Terms. Permitted uses include running tests, sharing results at your discretion, and using results as a general troubleshooting reference.

5 Prohibited use

You agree not to use the Service to:

• Send automated, scripted, or bulk requests that abuse or overload systems
• Probe, scan, or test vulnerabilities without authorization
• Bypass security or access controls
• Introduce malware or harmful code
• Disrupt or damage the Service
• Scrape or extract data using automated means without permission
• Violate law or others' rights
• Impersonate others or misrepresent affiliation
• Use the Service for commercial resale or competitive benchmarking programs without permission

Violations may result in suspension, blocking, or referral to authorities where appropriate.

6 Third-party services & advertising

The Service may link to third-party sites and may display ads from networks such as Google AdSense. We are not responsible for third-party content, practices, or terms. Third parties may use cookies as described in our Cookie Policy.

7 Intellectual property

Content, branding, code, marks, and other materials belonging to us or licensors are protected by intellectual property laws. Subject to these Terms, we grant a limited personal, non-transferable, revocable right to access the Service. You must not misuse our IP.

8 Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR SECURE OPERATION.

9 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VROOOMS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

Our aggregate liability for claims arising from the Service is limited to the greater of (a) amounts you paid us for the Service in the twelve months before the claim (if any) or (b) ten US dollars (USD 10.00), except where limited by law.

10 Indemnification

You agree to defend and indemnify us and our affiliates against claims arising from your use of the Service, breach of these Terms, or infringement of third-party rights.

11 Governing law & dispute resolution

These Terms are governed by applicable law. Disputes should first be addressed in good faith. Where permitted, you agree to individualized resolution mechanisms instead of class actions to the fullest extent allowable.

Final governing law and forum should be set with counsel.

12 Modifications

We may modify, suspend, or discontinue the Service. We may update these Terms by posting changes; the Last Updated date reflects revisions. Continued use may constitute acceptance where permitted.

13 Severability & waiver

If a provision is unenforceable, remaining provisions remain in effect. Failure to enforce a right is not a waiver.

14 Entire agreement

These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement regarding the Service and supersede prior understandings on the same subject.
